Important Notice to Guests
PLEASE READ CAREFULLY THE TERMS OF THIS BOOKING CONTRACT. By booking a charter with Cay Michele Charters, LLC (d/b/a St. Pete Sail Charters), you acknowledge and agree to the following terms and conditions.
Release, Hold Harmless, and Limitation of Liability
Guests acknowledge that sailing and water-related activities involve inherent risks, including but not limited to: drowning, slips, trips and falls, lightning, equipment failure, maritime perils, and dock activities. Participation in any charter activity is entirely voluntary.
By participating, guests agree to release, hold harmless, and indemnify Cay Michele Charters, LLC, its officers, employees, crew, owners, and agents from any and all claims, demands, causes of action, damages, losses, and liabilities arising out of or related to participation in the charter.
Photo and Video Release
Images and video may be taken during the charter and may be used by St. Pete Sail Charters for promotional purposes, including but not limited to the website, social media, and marketing materials.
Reservation of Right to Remove Guests
The captain and crew reserve the right to terminate a charter and/or remove any guest from the vessel for reasons of safety, disruptive or unsafe behavior, or any threat to the safety or comfort of other guests, crew, or the vessel.
Baggage, Personal Property, and Prohibited Items
All personal items brought aboard are subject to search at the captain's discretion. Marijuana and illegal substances are strictly prohibited aboard the vessel.
Limitation of Liability
Cay Michele Charters, LLC's liability is limited in accordance with 46 USC Sections 30501–30511. The company shall not be liable for emotional distress unless caused by intentional misconduct. No consequential or punitive damages shall apply.
Time Limits for Claims
Bodily injury: Written notice must be provided within 6 months. Any lawsuit must be filed within 1 year.
Other claims: Written notice must be provided within 30 days. Any lawsuit must be filed within 1 year.
Electronic Signatures
Electronic signatures are valid and enforceable per Florida Statutes Section 668.50 (Uniform Electronic Transaction Act).
